With the so-called “claims culture” in our society gaining momentum, it is important that businesses and organisations in every sector ensure they have proper risk management procedures in place to protect them as far as possible. Dentistry is no different.
With the recent well-publicised case of a dentist paying a five-figure sum to a former patient over allegations of maltreatment, the importance of protecting yourself and your business is again brought to the fore and, while it can be an onerous process to deal with all of the necessary red tape, it is essential that it be done. The introduction of Care Quality Commission registration to the profession brings yet more procedures to which to adhere, in addition to dealing with the General Dental Council, but doing so will ensure that dentists are properly equipped to deal with any challenges to them and their business that may arise.
Furthermore, as well as claims or complaints that may be made by patients, dentists must be alive to the importance of protecting themselves against any arising internal disputes by proper human resources and employment policies. Training should be sought where appropriate.
Furthermore, dentists need to be fully informed of medical ethics and handling of any medico-legal issues. While a good specialist dental lawyer will be able to give advice should the worst happen and a complaint be made, he or she should also be able to help you to identify risks and issues before they arise, thereby pre-empting any legal problems and protecting you from potential action.
